PROBATE

The Probate department of the District Court Clerk's Office is located on the 1st floor of the Johnson County Courthouse. The office is open from 8:00 a.m. to 5:00 p.m. Monday through Friday.

District Court Judge Charles Droege presides over probate cases.
District Court Judge Robert Wonnell presides over care and treatment cases.

Probate Forms

  • Small Estates Affidavit
    ***This form does not get filed with the clerk’s office. This affidavit may be used to obtain the transfer, to a decedent’s successor in interest, of certain personal property that would be transferrable to the decedent, without obtaining letters of administration or letters testamentary, where the total value of the estate subject to probate does not exceed $40,000. The transfer is treated as one to the personal representative of the decedent, and the receipt of the transfer operates as a full discharge and release of the transferor.
