IMMEDIATELY

Contact the Courthouse Clerk at [email protected] and update your name, address, telephone number AND e-mail address. This will allow us to contact you to prevent a possible suspension of your driving privileges or the issuance of a warrant for missing a court appearance.

If you wish to plead guilty:

If you wish to simply plead guilty and pay your fine you may do so by calling 913-715-3410, or

If you wish to plead guilty and need some time to pay, complete this motion and order forms and forward them to [email protected]. You will be given 360 days within which to pay your fines. That time CANNOT be extended. There are several payment options available. They will be sent to you via return email.

Diversion

If you want to divert your citation/ticket in order to keep it off of your driving record, you must immediately contact the District Attorney’s Office at 913-715-3410 or [email protected] for specific instructions regarding regarding their program.

Continuance

The request for continuance must be made 48 business hours before the court date by email to [email protected] and you will be granted 2 weeks.

When you appear for your arraignment date for your first appearance, you will be granted ONE 90 day continuance. When you come back to court after that time, you will be required to either have talked to the District Attorney’s Office and resolved the matter, or plead guilty to the charges and have the fines assessed or set the matter for trial. There will be no further continuances.

Charges with possible jail sentences

If your ticket includes an offense with possible jail time, i.e. Driving Under the Influence, Driving While Suspended or Reckless Driving you should contact an attorney. The attorney will know how to arrange a new court appearance. If you believe you cannot afford an attorney, you may complete this Financial Affidavit form and return it to the Clerk at [email protected] at least 48 hours before your assigned court appearance.

If you fail to do the above

If you fail to follow one of the above options, then you or your attorney must appear.

If you need special help due to language or hearing issues, to make sure an interpreter will be at your hearing you must email your name, case number, and spoken language immediately upon receipt of this Notice to either:

Warrants

If you have missed a court date and/or there is a warrant issued for you, you must email Traffic Court at [email protected].

FREQUENTLY ASKED QUESTIONS
Q What happens if I do not appear in court when my case is set for a hearing or trial? A Your driver’s license may be suspended and/or a bench warrant may be issued for your arrest.
Q Will you grant a continuance for the first time appearing in court? A You are allowed a one-time continuance prior to your court date unless you have posted a bond to appear.
Q Will you grant a continuance of a trial setting? A Motions for continuance of a trial will be considered by the court prior to the date of the trial and the opposing party must be given notice that the motion is being made. The court will not consider a motion for continuance of a trial by phone.
Q Can I make payments of fines? A Fines must be paid in full if paid with cashier prior to court. With a court appearance 120 days will be granted. Partial payments can be made up to the 120 limit. After that balance may be sent to collections along with 30% collections fee and license will be suspended.
Q How can I keep a moving violation from going on my driving record? A You are no longer able to double your fine to keep moving violations off of your driving record. The Johnson County District Attorney’s office offers a diversion program which prevents it from going on your driving record.
