CIVIL RULE NO. 10

Subpoenaed Business Records

When business records subpoenaed under K.S.A. 60-245a are transmitted to the attorney issuing the subpoena rather than, as the statute provides, the clerk's office, the attorney receiving the records shall:

1. If the records are transmitted in a separate sealed envelope as required by the statute, deliver or cause to be delivered the sealed envelope to the clerk's office.

2. If the records are not transmitted in a separate sealed envelope or if the envelope is inadvertently opened, serve a true and complete copy of the documents produced upon each party and file and serve on counsel a certificate that a true and complete copy of the documents produced has been served on all parties.
